EPC News: Rented Property

EPC- Energy Performance Certificate

1. This note summarises new requirements concerning commercial buildings- n/a to residential.
2. From 6 April 2008, anyone selling or leasing-out a commercial building (new or existing) of >500 sq. m. floor area must provide (to P or T) a valid EPC.
3. This will be extended to smaller premises from 1 October 2008.
4. The obligation arises on the first of:
a. providing written details re property to anyone requesting them;
b. interested party viewing premises; and
c. exchange of contracts.
5. The EPC must contain:
a. energy efficiency rating;
b. address of premises and usable floor area;
c. date of issue; and
d. assessor's name, and accreditation scheme of which assessor is a member.
6. No local authority completion certificate (Building Act 1984) wil be issued unless an EPC is produced.
7. For a new construction, a predicted energy assessment can be produced as an interim measure.
8. Separately, and from 6 April 2008, any building >1000 sq. m. used by local authorities and others providing public sevices to a large number of visiting people also needs to exhibit prominently a Display Energy Certificate- format differs from EPC, but the idea is similar.

From 1st October 2008, if you are renting out property you will need to provide a Energy Performance Certificate (EPC ) to any prospective tenant. However, there is no need to obtain a certificate for existing tenants. The certificate is valid for 10 years but can be renewed earlier if the landlord wishes to reflect any improvements made. If a valid certificate exists when changing tenants no new certificate is required.
It is recommended that landlords have Energy Performance Certificatesªproduced for their rental properties sooner rather than later as it isªlikely there will be a rush to conform with legislation prior to the October 2008 deadline.

Home Information packs are NOT required for:
Seasonal and holiday accommodation.
Mixed sales e.g. Shop and flat.
Right to buy and similar sales.
Sales of portfolio of properties.
Properties being sold not with completely vacant possession.
Unsafe properties and properties for demolition
Rental properties. HIPS only apply to selling.
